TERMS AND CONDITIONS OF BUSINESS

By purchasing goods and services from us you enter a legally binding contract with us on the following terms.  You should read and understand these terms because they affect your rights and liabilities.

These terms describe the basis for purchase by you and sale by us of the products and services via written or verbal quotation.

The Contractor

The term 'contractor' shall mean Primrose Garden Maintenance Limited.

The contractor agrees to perform the work as summarised in the quotation.

The Client

The term 'client' or 'customer' shall mean the person or persons who have authorised the contract and shall be deemed to have authority to enter into the contract on behalf of the owners (or owners agent) of the garden / grounds in which the works are to take place.

Additional Work

Where additional work is requested outside the original quotation, it will be charged at the current standard rate on a person-hour basis unless otherwise agreed in writing or verbally and the cost must be agreed in advance of the additional work taking place.

Force Majeure

Either party shall not be liable for the cancellation of the contract because of war, flood, fire or death.  The contractor has the authority to delay the services should items of property be stolen in respect of the work carried out.

Expiry of Estimate / Quotation

Estimates and quotations are valid for 60 days from submission date, unless otherwise stated on the estimate or quotation, after which period the contractor reserves the right to withdraw and submit a new estimate.

Payment Method

Our preferred method of payment is by direct bank credit into our account which will be detailed on the invoice.  Alternatively please make cheques payable to Primrose Garden Maintenance Limited.

Payment is due upon completion of the contract, unless otherwise stated on the quotation.  A surcharge of 3.0% of the invoice amount per overdue month may be levied on all accounts not paid within 30 days of the date of the invoice.  Costs incurred collecting overdue accounts will be the responsibility of the client. Regular works are invoiced at the end of each calendar month, with payment terms detailed.

Materials / Products

All materials and products remain the property of the contractor until full payment has been received and all funds cleared on any cheques used as payment.

Cancellation

Cancellation of work not received within 5 working days of scheduled start of work may be subject to a charge of 15% of the quoted price.

Complaints

Any complaints with the contractor should be raised by the client, in writing, within 7 days of first becoming aware of the complaint and must be within 28 days of completion of works.

Ownership

It is assumed that all areas specified in the quotation are owned by the client or the client has the authority to permit the works unless otherwise stated.

Underground Services and Electrical Wires

Although every care will be taken to avoid such services, unless the exact location of underground pipes, wire or cables are clearly marked on site, or detailed on a plan prior to the formation of the contract, or work commencing the contractor shall be under no liability for any damage through work performed under the contract.

It is imperative that the client makes the contractor aware of any electrical wires not contained within armoured protection before work commences.  No liability can be taken should non armoured cables be damaged, plus the contractor reserves the right to sue for damages should injury or death occur whilst undertaking work for the client and this information has not been made aware to the contractor.

Weather

Completion of contract can be dependent upon weather conditions.  Work operations delayed by poor weather conditions will be resumed as soon as conditions allow and the contractor shall not be liable for any costs incurred for any delay in completion due to weather conditions.  However we do everything we can to ensure the work is completed on time.

Vandalism

Damage through vandalism of part completed work whilst the contractor is not on site will not be the responsibility of the contractor.

By agreeing the proposed works the client is deemed to have read and understood the contract and agrees to abide by the terms of agreement set out in it.

The terms of Agreement cannot be changed unless agreed by both parties in writing.

PRIVACY POLICY  

We understand that you want the personal information you give us to be kept private as well as secure.  We would like to reassure you that we feel the same way.  So here's how we will and more importantly will not use the personal information you give us.

When you contact us we ask for information such as your name, address and contact details.  We record this information so that we can identify you as a customer or a client.  We keep details of work required / quoted / completed to help us with forward planning.  We keep a copy of any e-mail or written correspondence you send and telephone calls are recorded via written notes in order to assist us with work scheduling and to operate and improve the service we offer you.

We are committed to using your personal information only for -

Dealing with orders and accounts for the supply of our goods and services.

Planning and managing our business activities and customers' maintenance requirements.

Providing you with information about the goods and services we offer.

Assessing your request for goods or services from us where we may make enquiries about you, including searching your records held by organisations like Experian and Equifax and other credit reference agencies but before we do this we will obtain your authority.

Enabling our debt collection agency to collect payment from you should that be necessary. Our accountant, legal team and government officials may also look at the data on a need to know basis only.

At all times where we use or disclose your information it will remain secure.

We retain data for the minimum length of time legally necessary to satisfy HMRC and other government department requirements.  For example in the case of invoices and payments received information we retain for 7 years. Quotations which are not awarded are retained for two years.  Quotations awarded to us are retained for 7 years as they will then form part of our income and expenditure records.

Once the retention time has lapsed we dispose of the records in a timely and confidential manner.  This applies to both paper and electronic records.

There are only two circumstances where we may share some of your data with others -

With agents we use or who assist us in the service we provide to you, including our select list of approved sub-contractors, credit reference agencies, detection agencies and debt collection agencies, our accountant, legal team and government officials.  In these circumstances we provide them with only the information they need to perform their function.

In the unlikely event that our business assets are ever sold to or purchased by another company. (Our data records are part of our business)

How we DO NOT use your personal data.

We will never sell or rent your data to anyone else for their marketing purposes unless you agree otherwise.  You will always have the right to withdraw your data from this use by requesting as such in writing.

 

If you have any complaint or concerns regarding our privacy policy we would welcome the chance to discuss with you.  You also have the right to contact the Information Commissioner's Office ( ICO) details of whom can be found on their web site to discuss any complaint or concern.
